Kuwait Clarifies Worker Rights on Contract Termination

Kuwait has told private-sector workers that in some cases they can leave their jobs without giving prior notice and still keep their end-of-service benefits.

The Public Authority for Manpower said this applies when the employer breaches the employment contract or Labour Law, when the worker is assaulted by the employer or the employer’s representative, or when there is a serious risk to the worker’s safety or health, as long as the legal conditions are met.

The guidance was issued as part of PAM’s “Know Your Rights” campaign.

It also explained when an employment contract may end automatically by law.

These cases include the death of the worker, a proven inability to do the job, the end of statutory sick leave, the permanent closure of the company, or a final court ruling declaring the employer bankrupt.

Employers also have the right to end employment in cases allowed under Kuwait’s Labour Law.

For indefinite-term contracts, an employer may end the agreement by giving the required notice. In more serious cases set by law, a worker may also be dismissed without notice.

PAM said workers still have the right to challenge a dismissal if they believe it was unfair.

The authority referred to Articles 41, 44, 46, 48, 49 and 50 of Kuwait’s Labour Law, depending on how the employment relationship ends.

The aim of the guidance is to help workers and employers understand their rights and duties before ending any employment contract.

The authority said termination of an employment contract has clear reasons and procedures, and knowing the law helps protect both sides and support a fair and safe work environment.
